Legal Briefs - SEC vs Ripple Apr 30th

Live Update of Conference call: SEC vs Ripple

    Posted: 30 Apr 2021 06:59 AM PDT

Currently listening in on the call. Someone suggested maybe doing a live update thread. I will do my best to articulate and update as things play out. By no means am I a legal expert on what's happening, but will do my best. Highly encourage others that may be listening in to provide feedback and interpretations.

TLDR: Ripple argued the SEC's use of the Memorandum of Understanding (MOU) is a gross overreach as it provides the SEC an unlevel playing ground for discovery as the MOU's are US government-backed and inherently suggests involuntary discovery from foreign entities. SEC argues they are well within their right to use the MOU process as is and that Ripple was aware of this process prior. They also argue Ripple has access to the same information via FOIA request. The judge is not ready to give an opinion at this time and will give a written opinion later on after advisement.

    Updates:

10:03-Check-ins between judge Netburn and parties have begun.

10:06-first talking about SECs use of MOU with foreign entities as it pertains to discoveries

10:08-Ripple arguing gross overreach of discovery powers with foreign entities.

10:09-Ripple directing the judge to stop SEC from using these MOUs and produce any documents issued to these parties.

10:11-Judge asking if any case law pertains

10:15- Ripple: We have no case law that we can site or that would benefit us on this point. Ripple arguing MOU is forcing information instead of volunteering information. SEC is arguing that MOU is within its rights to use MOUs as discoveries as it's part of an international agreement.

10:30-The defense is arguing the SEC has bypassed the court rules by using the MOU process, and once they got that information they can skew it without following the rules. We have a subpoena in this court. The SEC kept secret their use of MOU from the court and defendants. They have to abide by the rules of the court.

    Court Adjourned

    Posted: 30 Apr 2021 07:57 AM PDT

Court has been adjourned with no ruling, but both sides arguments being taken under advisement by the Judge.

In listening to the case, I think Ripple made some good arguments in the imbalance of power to acquire documents and the SEC not being very forthcoming until the 11th hour.

    No streaming the court case!

    Posted: 30 Apr 2021 06:47 AM PDT

This shouldn't need to be said but I've seen a few people asking where they can watch it or who is going to stream it.

You are allowed to listen in if you are granted one of the 4000 slots and you can update in real time what's happening, but you are NOT allowed to record or stream the trial.

Doing so may mean we won't be able to listen in on future trials and may damage our position.

If you see anybody streaming it anywhere, flag it and ask the streamer to stop. It's for all our best interests.

    When is the next hearing?

    Posted: 30 Apr 2021 08:58 AM PDT

Today I felt that the judge wanted Ripple to give every reason to make a decision in their favor. It's going to be a big decision for the concept of cryptocurrency in general. So when is the next hearing date.

Questions about Flare, Spark and XRP; for anyone informative about it

    Posted: 30 Apr 2021 07:30 AM PDT

Can someone explain to me if possible how the Flare, Spark integration will happen and do I have to do something to get those tokens. What will the tokens do and how will it affect XRP and what is its purpose. I used to have my XRP on binance but my account is now closed so what should I do to acquire my tokens? Any additional information would be highly appreciated; trying to learn as much as I can about this integration. Thanks in advance.

    20xrp new account

    Posted: 30 Apr 2021 11:30 AM PDT

    Hi all,

Probably been asked before but I just sent some xrp from an exchange to a private software multicoin wallet and noticed that ripple takes away 20xrp to account for this new account. Does this mean this 20xrp is basically lost? And more importantly is that 20xrp cost set in stone, meaning that if one day xrp goes to 10$ which is not that super unlikely in a hyper-bull run, you are actually paying 400USD to open up a new account? Hope that is incorrect as that would be insane.

Thanks for any insights on this.

Does RippleNet (xCurrent) Will Eliminate Corresponding Bank?

    Posted: 30 Apr 2021 05:58 AM PDT

Hi, everyone! I was learning about how RippleNet works on cross border payment and I can's seem to figure out whether xCurrent able to eliminate corresponding bank. So, I found a video that explain how xCurrent actually work. On that video, it shows that cross border payment goes through from originating bank (originated bank FX desk -> please explain what's this) to corresponding bank (originated bank nostro account) then from corresponding bank (liquidity provider) to beneficiary bank.

    a screenshoot from the video

then on Ripple's xCurrent brochure, it shows that there's no beneficiary bank through out the process of cross border payment. I am very confused. My questions are:

    1. Is there actually correspondent bank in cross border payment using RippleNet? If yes, are they exchanging using XRP?
    2. If they do exchanging using XRP, then why there's still nostro account on corresponding account? and why the video included corresponding bank?
    3. Is it the liquidity provider Ripple? since it offers liquidity on demand. if so, does that mean Ripple is the one who post FX rates?
    4. Why Ripple doesn't show correspondent bank on the brochure?
    5. Which business model of xCurrent is right?

I might asks more question after this since I'm very new to Ripple and cryptocurrencies. I will really appreciate your help and thank you! (Sorry for my grammar mistakes, English is not my first language)
