SEC Reply to Response to Motion filed 5/3/21:
"The Court Ordered the Parties to Meet and Confer as to Whether Any Internal Documents "Expressing the Agency's Interpretation or Views" Were Subject to Discovery, and No Such Documents Exist."
...
"Defendants further incorrectly claim that the "SEC acknowledged that it has internal memoranda that relate to XRP, bitcoin, and/or ether that are responsive to Defendants' discovery requests." Id. These assertions are untrue"

Submitted 5/3/21 on behalf of Ripple's Defence. (Docket Entry 152)
In a 21 page letter to the court:
" Defendants support the named Movants' participation in the case. Although Defendants oppose Movants' motion to intervene to represent a putative class, the Court should permit them to participate as amici with elevated rights or as intervenors with limited rights. "

If XRP is a security so is The Dollar?

Am I right in understanding that:

The Treasury Department is the Factual jurisdiction legally assigned to deem either 1) a Currency; 2) a Security; regarding these sorts of formal procedures:

1) If a Currency,

De Facto not a Security, thus not under SEC jurisdiction.

2) If a Security,

deemed not a currency; within SEC jurisdiction.

Is this not the legal Hierarchy structure? Otherwise the SEC could accuse the Treasury of printing a security?
