    Making it thus a David and Goliath showdown, so having a legal aid defendant against an army of SEC lawyers. Which is why participants in this ecosystem – perhaps those that have raised millions in token sales, or ConsenSys or some fine lawyer who wants to make a name for himself – might want to file briefs in support of the defence.

    Because this may be a precedent setting case, with the fate of a billion dollars industry and perhaps that of innovation in America standing on the hands of a Cornell Law School graduate and trial attorney.

    tl;dr: First US court case to decide whether a token is a security or not, may be precedent-setting. The defendant attorney is not addressing the fraud in the specific ICO, but questions the whole indictment based on the applicability of securities laws to tokens. She's alone against a team of SEC lawyers. If you are a lawyer or a big crypto firm, this may be your time.

    In my last post on this, Remove Code duplication in Ethereum, reduce significantly gas usage?, I promised to collect statistics for my claims -> Stats collected.

    Counted at block number 5 200 035, there are 5 212 554 contract instances. 5 158 545 contract instances have their code more than once deployed. Gas wasted since genesis -> 586 814 475 200

    Ok, we can do it better nowadays, we have delegatecall and extcodecopy/size and libraries like https://github.com/yarrumretep/clone-factory.

    Let's calculate what would have happened, if people would have applied clone-factory from the beginning on. Based on the assumption it is only used for contracts that are deployed more than once (5 158 545 at block 5 200 035). Let's further assume, each contract has received in average 3 TXs during it's lifetime, hence 3x overhead for the delegatecall.

    Overhead per contract instance -> (21000 + 32000 + 12000) for the forwarder creation + (3 x 1000) for 3 delegatecall = 68 000 gas

    Wasted Gas with the clone-factory: 5 158 545 contract instances x 68 000 overhead for the clone-factory => 350 781 060 000 gas wasted. only ~40% less than without this pattern.

    With EIP-911 -> 0 gas wasted.

    For me the math looks perfectly clear. Any objections on this? Show me that I am wrong, so I can close this issue, otherwise I can not stop thinking about it. ;-)

    Just watched an OMG promo vid and they used the tagline "Powered by Etehreum". (https://youtu.be/oKixWoEr9-o)

    IMO this would make a great brand / tagline for developers + companies to apply to + promote their DApps and products run on Ethereum.

    Throwing this out there in the hope that other (more capable) graphic designers will run with and develop some sort of logo to apply in this regard!
